PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BECAUSE THEY SET FORTH THE IMPORTANT TERMS YOU WILL NEED TO KNOW ABOUT THE SERVICES.

YOU UNDERSTAND THAT BY ACCESSING OR USING THE SITES OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE LEGALLY BOUND BY AND COMPLY WITH THESE TERMS OF USE. IF YOU DO NOT OR CANNOT AGREE WITH ANY PART OF THESE TERMS OF USE, YOU MAY NOT USE THE SITES OR ANY SERVICES PROVIDED ON OR THROUGH THE SITES.

THE TERMS OF USE ARE SUBJECT TO CHANGE AS PROVIDED HEREIN.

Introduction

Rejuve, Inc., together with its respective affiliates (collectively, “Rejuve Meds,” “we,” “us,” or “our”), owns and operates the website located at https://www.rejuvemeds.com (the “Website,” and together with any affiliated mobile application (“App”), the “Sites”).

The Sites are intended to facilitate the provision of services to registered users. The “Services” may include:
(i) providing individuals with information on health care and wellness (“Content”);
(ii) providing individuals with pharmacy services;
(iii) providing individuals with access to technology-oriented tools for health and wellness programs;
(iv) development and gathering of health care records and health care information with retention of the same for use in health care provider appointments, communications, and pharmacy services;
(v) administrative support in connection with scheduling and payment for health care provider services and pharmacy services; and
(vi) telecommunications support for using the Services as a means of access to health care providers provided by Beluga Health, P.A. and similar affiliated professional entities for communication, consultations, assessments, and treatment by such health care organizations and their providers.

These terms and conditions of use (“Terms of Use”) describe your rights and responsibilities with regard to the Rejuve Meds Sites that you may use to receive Services. Your access to and use of the Sites is subject to these Terms of Use, our Privacy Policy available on the Sites, as well as all applicable laws and regulations.

Even though you may have arrived at the Sites through a website or mobile application operated or controlled by a third party, you understand and agree that these Terms of Use are entered into between you and Rejuve Meds.

Use of the Sites or Services constitutes acceptance of these Terms of Use and the Rejuve Meds Privacy Policy.

Availability

Certain Services are only available to individuals located in states where Rejuve Meds operates.

Eligibility

To qualify to use the Services:

You must be 18 years of age or older
You must be located in a state where the Services are offered
You must agree to be legally bound by these Terms of Use

Satisfying these requirements does not guarantee that you will receive Services. Rejuve Meds and affiliated professional entities reserve the right to modify eligibility requirements at any time.

Requirements for Use

You must have compatible devices, internet access, and required software. Fees and data charges may apply.

Special Consent to Telehealth Services

Telemedicine involves the delivery of health care services using electronic communications when a patient and provider are not in the same physical location. Telemedicine may include:

Electronic transmission of medical records and personal health information
Audio, video, and/or data-based interactions
Use of data from medical devices

Security measures are used to protect the integrity and confidentiality of health information.

Please review the Consent to Telehealth, which is incorporated into these Terms of Use by reference.

Privacy Policy

Rejuve Meds values your privacy. Please review:

The Rejuve Meds Privacy Policy available on the Sites; and
The Rejuve Meds Professionals Notice of Privacy Practices applicable to Beluga Health, P.A. and similar affiliated professional entities.

Your Relationship With Rejuve Meds

Rejuve Meds does not provide medical care. Rejuve Meds provides a technology and administrative platform that enables access to licensed health care providers affiliated with Beluga Health, P.A. or similar entities.

You understand that using the Services does not create a provider-patient relationship with Rejuve Meds.

Communications by Text Message and Email

By opting in, you consent to receive SMS and email communications related to your account, orders, provider communications, and optional marketing messages.

You may opt out of SMS at any time by texting STOP.

Messages and emails are not encrypted, and you acknowledge the associated risks.

Registration and User Accounts

You must register to access Services. You agree to provide accurate information and keep your credentials secure. Notify us immediately of unauthorized use at care@rejuvemeds.com.

Access Rights and Prohibited Use

You are granted a limited, non-transferable, non-commercial right to use the Sites. Prohibited activities include misuse, reverse engineering, unauthorized access, or commercial exploitation.

Pharmacy Services

If prescribed medication, you may choose Rejuve Meds or a partner pharmacy (the “Rejuve Meds Pharmacy Network”) for fulfillment. You consent to sharing information necessary to provide pharmacy services.

If you choose the Rejuve Meds Pharmacy Network, medications may not be shipped in child-resistant packaging.

Payment

You authorize Rejuve Meds and its payment processors to charge applicable fees. Services may be suspended until payment is received.

Special Notice to Medicare and Medicaid Beneficiaries

Federal and state programs do not cover services provided through the platform.

Governing Law; Arbitration

These Terms are governed by Delaware law. Disputes are resolved through binding individual arbitration in New York, NY, except for intellectual property claims.

Termination

Rejuve Meds may suspend or terminate access at any time. Certain provisions survive termination.

Disclaimer of Warranties & Limitation of Liability

THE SITES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, REJUVE MEDS DISCLAIMS ALL WARRANTIES AND LIMITS LIABILITY.

Indemnification

You agree to indemnify and hold harmless Rejuve Meds and its affiliates from claims arising out of your misuse of the Sites or Services.
